rental and booking conditions, cancellation policy
1. PURPOSE AND USE:
Villa Brisa and Villa Chill are each suitable for a maximum of 8 people. It is not permitted to occupy the villa with more than the stated maximum number of people, except for babies in a crib. The main renter must be at least 25 years old and must be present throughout the rental period to supervise the youth/children who are also staying in the property. We do not rent to youth/student groups. Upon booking, we require a copy of the main renter's passport. The villas are intended for vacation stays. Changes to the purpose or use by the renter are not allowed. The villas are rented out fully clean and in a tidy condition. Upon departure, the renter must return it in a tidy state (cleaned up). The landlord assumes
that everything will be in its place upon departure, the dishes will be done, the last dishes will be in the
dishwasher, and the used household appliances will be cleaned. If additional
cleaning costs are incurred, these will be charged to the tenant via the deposit (see
deposit conditions). The BBQ must also be left clean. If it is left dirty,
a charge of € 75 will be made, payable to the manager at check-out.
The tenant shall respect the rental guidelines and treat the rented property and its contents with care in all
situations, such as closing windows and doors in case of wind/rain,
locking the house when absent, and switching off all electrical appliances when they are
not in use. If nuisance is caused to surrounding residents, the
landlord reserves the right to terminate the contract with immediate effect. In that case,
no refund of rent paid will be made. It is not permitted to transfer rights or sublet the property to third parties.
2. PAYMENT AND TERMS:
The renter receives the quote and invoice via email. The rental price must be paid in 2 installments: a 50% deposit within 7 days after booking and the remaining 50% including a deposit no later than 60 days before arrival. The reservation is only final once the 50% deposit has been credited. If the rental agreement is made within 4 weeks of the arrival date, the entire rental price must be paid in 1 installment. The renter gains access to the rented property once the booking form is filled out and signed, along with a copy of the main renter's passport and full payment has been received. Check-in is possible on the day of arrival after 4 p.m., check-out on the day of departure before 11 a.m.
In consultation with the manager, this can be later if there are no new tenants.
The landlord reserves the right to terminate the agreement due to compelling
circumstances. In that case, the tenant will be notified as soon as possible of the
cancellation of the rental contract and the rent already paid will be refunded within two weeks of cancellation.
3. DEPOSIT:
For each booked period, a security deposit of € 650 will be paid by the tenant. The refund of the deposit will occur within 14 days after the end of the rental contract. The following items will be deducted from the deposit:
- Excess energy consumption per Villa (including 50 kWh per day); excess consumption cost is € 0.55 per kWh.
- If the property is not left garbage-free, € 25 will be deducted from the deposit.
- The dishes must be placed in the dishwasher and/or left clean. If left dirty, € 25 will be deducted from the deposit.
The deposit must be transferred at least 60 days before arrival, simultaneously with the second installment of the rental price.
4. PRICES:
The rental prices and other costs can be found on the booking site of AIRBNB and VRBO. The beds are made upon arrival and there are sufficient towels and beach towels available. During the interim cleaning, these are changed (interim cleaning is mandatory after every 7 nights of stay). Extra bed and bath linen is available on request and for an additional fee. Not included in the rental price:
- Electricity and water consumption. The meter readings will be noted by the manager upon arrival and departure. Consumption per villa above 50 kWh per day will be charged and settled with the return of the deposit. The cost for electricity is € 0.55 per kWh.
- VAT 7% on the rental price.
5. INSURANCE:
We advise you to take out a good travel and cancellation insurance with worldwide coverage. The villas and furnishings are insured against the usual risks and according to the usual conditions with a local insurance company. Tenant's belongings are not insured under this policy.
6. LOSS, THEFT, DAMAGE/DESTRUCTION
Upon signing the rental conditions, the tenant signs for liability in case of loss, theft, and breakage/damage to goods belonging to the furnishings of the property upon arrival. The tenant also declares to treat the household goods and everything related to it in and around the rented object well. Damages must always be reported to the manager. The landlord has no liability regarding loss/theft/injury/force majeure in case of water disruptions or power outages for the tenant during the occupancy of the villa.
The landlord is not liable for:
- Theft, loss, or damage of any kind, during or as a result of a stay in Villa Chill and/or Villa Brisa.
- The malfunctioning or deactivation of technical equipment, temporary outages, or disruptions
- Unannounced roadworks and construction work around the property.
- Failure to perform the lease agreement in whole or in part in the event of force majeure. This
also includes negligence on the part of service providers engaged by the lessor.
- Violation of applicable rules and nuisance caused by activities outside the rented property.
- Force majeure of any kind.
- Accidents in and around the swimming pool.
- The manager or landlord cannot be held liable for accidents in or around the house.
7. VISIT FROM MANAGER OR LANDLORD:
The landlord or manager is allowed to visit the villas by means of an appointment with the tenant, with the aim of checking whether all obligations are being fulfilled. This right must take into account the tenant's privacy and will be exercised in moderation.
8. LIABILITY:
The tenant can be held liable for theft of and damage to the furnishings if the theft occurs without signs of forced entry. In the case of theft without signs of forced entry, for example, due to not locking windows or doors while absent, the tenant is liable for damages to the landlord's property. The landlord/manager is not liable for accidents in and around the swimming pool and accidents in or around the house.

Any printing errors in the general terms and conditions, on our website, or other forms and documents are subject to change.
The landlord reserves the right to make changes at any time.
Under no circumstances is the landlord liable and responsible for any damage incurred to all parties involved or movable and immovable property. The tenant hereby waives any claim against the landlord, the owner of the villas.
This rental agreement is governed exclusively by Dutch law. All disputes arising from the rental agreement will be handled by the court in Curaçao.
